These Terms of Service ("Terms") govern your use of the Harbour mobile application ("App") operated by Harbour ("we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Harbour companions are fictional AI characters, not real people. All companions — including their names, photos, personalities, and messages — are AI-generated personas. Harbour makes no representation that companions are human. Companions will never claim to be real people, offer to call or text you from a real phone number, or agree to meet you in person. Any such claim within the App should be understood as a malfunction, not a real offer.
Conversations are powered by large language models (currently DeepSeek and xAI's Grok). AI responses may be inaccurate, inconsistent, or unexpected. Do not rely on companion responses for medical, legal, financial, psychological, or other professional advice.
You must be at least 17 years old to use Harbour. To enable Spicy Mode, you must be at least 18 years old and complete the in-app 18+ opt-in confirmation. By using the App, you represent that you meet the applicable age requirement. If we learn that a user is underage, we will terminate their account.
Harbour does not currently require account registration. Your profile, preferences, and chat history are stored locally on your device. You are responsible for your device and the data on it. We cannot recover data if you lose your device or uninstall the App.
Harbour offers three tiers: Free, Gold, and Platinum. Gold and Platinum are paid auto-renewable subscriptions processed by Apple through the App Store.
Subscriptions automatically renew at the end of each billing period (monthly, quarterly, or annual) unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged within 24 hours prior to renewal.
You may cancel at any time through iOS Settings → [Your Name] → Subscriptions → Harbour. Cancellation takes effect at the end of the current billing period — you retain access to paid features until then. We do not offer refunds except as required by Apple's policies or applicable law.
We may change subscription prices at any time. Price changes will not affect your current billing period. Apple will notify you of price changes and require your consent before charging the new rate.
When offered, free trials automatically convert to paid subscriptions at the end of the trial period unless cancelled before the trial ends.

Spicy Mode is an opt-in feature available exclusively to Platinum subscribers. By enabling Spicy Mode, you confirm you are at least 18 years old. Spicy Mode enables more expressive, flirtatious companion responses within the limits described below.
Hard limits that apply regardless of mode:
Harbour is an entertainment app, not a mental health service. Companions are not trained therapists, counselors, or crisis counselors. If you are experiencing a mental health crisis, please contact a real mental health professional or a crisis line such as the 988 Suicide & Crisis Lifeline (call or text 988 in the US).
Companions may respond supportively to personal disclosures but are not equipped to provide professional care. Do not use Harbour as a substitute for professional help.
All content in the App — including companion characters, names, personalities, artwork, and the App itself — is owned by Harbour or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from App content without our written permission.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESPONSES WILL BE ACCURATE OR APPROPRIATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBOUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING LOSS OF DATA, EMOTIONAL DISTRESS, OR ANY RELIANCE ON AI-GENERATED CONTENT. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Harbour and its affiliates from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or your use of the App.
We may suspend or terminate your access to the App at any time if you violate these Terms, without notice or liability. You may stop using the App at any time by uninstalling it.
We may update these Terms from time to time. We will update the "Last updated" date above. Continued use of the App after changes constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the United States and the state in which Harbour is incorporated, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of that jurisdiction.
